By deploying, installing, or using AI Agent ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

## 1. SERVICE DESCRIPTION
AI Agent is autonomous software with unrestricted system access that:
- Executes commands with root/administrator privileges
- Installs packages and modifies files autonomously
- Accesses the internet and external APIs
- Makes autonomous decisions based on AI models
- Processes and stores data in your infrastructure
XT Agents is also offered as a hosted subscription service where users can subscribe and access managed agent execution, storage, and related platform capabilities.
By using the hosted service, you acknowledge that outputs are generated by autonomous AI systems, may be incorrect or harmful, and must be reviewed by you before use.

## 1A. SUBSCRIPTION SERVICE TERMS
For subscribed/hosted service users:
- Access is provided on a subscription basis and may include usage limits, session limits, and time limits.
- You are solely responsible for how you use the service and for all actions taken through your account.
- You are solely responsible for reviewing and validating AI-generated outputs before operational, legal, financial, medical, or security use.
- We do not guarantee that service outputs are accurate, complete, lawful, or fit for your intended purpose.
- We may suspend, throttle, or terminate service access for abuse, policy violations, non-payment, or security risk.

## 2. "AS IS" PROVISION
### THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We make NO WARRANTIES, express or implied, including:

**Security Risks:**
- The agent has unrestricted system access
- The agent can execute any command
- The agent can modify or delete files
- The agent can install software
- Security vulnerabilities may exist
**AI/LLM Risks:**
- AI models can make mistakes
- AI models can hallucinate or provide incorrect information
- AI models can take unexpected actions
- AI behavior may be unpredictable
- AI models evolve and change over time
**Operational Risks:**
- The agent may consume significant resources
- The agent may incur API costs
- The agent may cause system downtime
- Data may be lost or corrupted
- Third-party integrations may fail
**Legal/Compliance Risks:**
- You are responsible for all actions taken by the agent
- You must ensure compliance with applicable laws
- You are responsible for data protection/privacy compliance
- You must obtain necessary permissions and licenses

## 4. YOUR RESPONSIBILITIES
You are solely responsible for:

✓ Managing third-party API keys and costs

✓ Any damages or losses resulting from agent actions

## 5. LIMITATION OF LIABILITY
### TO THE MAXIMUM EXTENT PERMITTED BY LAW:
**WE SHALL NOT BE LIABLE FOR:**
- Direct damages
- Indirect damages
- Incidental damages
- Consequential damages
- Special damages
- Punitive damages
- Loss of profits
- Loss of revenue
- Loss of data
- Loss of business opportunity
- System failures or downtime
- Security breaches
- Actions taken by the AI agent
- Third-party API costs
- Any other losses or damages
- Any damages arising from your use of subscribed/hosted service features
- Any decisions made by you based on AI-generated outputs
- Any user account misuse, unauthorized access, or credential compromise not caused by our gross negligence
**MAXIMUM LIABILITY:** If any liability is found to exist, our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
